WARRANTY AND RETURNS

 

1. GENERAL INFORMATION
Ownership of this website, beeloomkids.com (hereinafter, the “Website”), is held by BESELF BRANDS S.A. (hereinafter, “Beeloom”), with tax identification number NIF: B65114373, registered with the Commercial Registry of Tarragona, Volume 2847, Page 6, Sheet T-47561, Entry 4.

This document (as well as any other documents referenced herein) governs the conditions for using this Website (beeloomkids.com) and for the purchase of products and/or services through it (hereinafter, “Terms”).
For the purposes of these Terms, Beeloom’s activity via the Website is defined as the sale of educational toys for learning purposes.

Before accessing, browsing or using the Website, users must have read the Legal Notice, including the Cookie Policy and Privacy Policy. By using the Website or purchasing a product/service, users agree to be bound by these Terms. If they do not agree, they must not use the Website.

These Terms may be amended. It is the user's responsibility to review them each time they access the Website. For any questions, the user may contact Beeloom via the details provided above or using the Website’s contact form.

2. THE USER
By accessing and browsing the Website, the visitor becomes a user (hereinafter, the “User” or “Users”) and accepts these Terms and any subsequent amendments.
Users agree to use the Website lawfully, including:

  • Only making legitimate enquiries or purchases.

  • Not placing any false or fraudulent orders (which will be cancelled if suspected).

  • Providing accurate and lawful contact details.

Users confirm they are at least 18 years old and legally capable of entering into contracts. This Website is intended primarily for users resident in Spain. Beeloom offers no assurance that the Website complies with legislation outside Spain and disclaims liability in that respect.

3. PURCHASE PROCESS
Registered users may purchase products via the Website using the available process.
Users add items to their basket, proceed to checkout and click “BUY”. Before finalising the purchase, they may review and modify their order.

Upon ordering, the user will receive a confirmation email. A separate email will be sent once the order is dispatched. An electronic invoice will also be issued. A paper invoice can be requested by contacting Beeloom.

Users acknowledge having read the key characteristics of the product/service (e.g. name, price, components, weight, colour, shipping costs), which are shown alongside product listings, and agree to the specific sale conditions.

All transactions may be stored electronically for legal and security purposes in compliance with GDPR (EU Regulation 2016/679) and Spanish data protection law (LOPDGDD).

4. AVAILABILITY
All orders are subject to product availability and unforeseeable circumstances. If items are out of stock or delivery is not possible, Beeloom will contact the user and issue a refund. The same applies to services that cannot be fulfilled.

5. PRICES AND PAYMENT
Prices shown on the Website are final and include VAT (in Euros). Delivery charges are included in the price unless otherwise stated.
Beeloom uses GLS and DHL for shipping.
Payment methods accepted: credit/debit card, bank transfer, or PayPal.

The Website employs SSL encryption to ensure secure payment. Credit cards are subject to authorisation. If declined, no contract will be formed.
A pre-authorisation may be taken at the time of order; the card will only be charged upon dispatch.
By clicking "BUY", users confirm that the payment method belongs to them.

6. DELIVERY
Shipping is available to: mainland Spain and the Balearic Islands; mainland Portugal, France, Italy, and Germany (excluding islands).
Shipping is not available to: Canary Islands, Ceuta, Melilla, Corsica, Guadeloupe, Sardinia, Azores, Madeira.

In the absence of the user during delivery, the courier will leave a notice.
If undelivered after 30 days for reasons not attributable to Beeloom, the contract will be deemed cancelled, and a refund will be issued (excluding any additional delivery costs).
Ownership and risk transfer to the user upon delivery.

VAT rules apply in accordance with Spanish law (Law 37/1992).

7. CORRECTION OF ERRORS
If users detect an error during the ordering process, they can amend it by contacting Beeloom via the Website or their account area.
Users should review their basket before clicking “BUY”.
For further rights concerning data rectification, refer to the Privacy Policy in line with GDPR and LOPDGDD.

8. RETURNS
Voluntary Right of Withdrawal
Consumers may withdraw from the purchase within 14 calendar days without justification.
The return period starts from the day the user or a third party (other than the courier) takes physical possession of the goods.

To exercise this right, users must notify Beeloom via the contact form or:

Returned items must be in original condition and packaging, with all documentation and a copy of the invoice. Return shipping is at the user's cost.
Refunds will be made using the original payment method within 14 days, but may be withheld until goods are received or proof of return is provided.

Exceptions
Withdrawal does not apply to:

  • Customised products

  • Perishable items

  • Opened hygiene or health-related items

  • Fully performed services where execution has begun with explicit consent

Faulty Goods or Delivery Errors
If a product is defective or does not match the order, users must contact Beeloom immediately.
Beeloom will offer a refund or replacement depending on availability. The refund includes delivery and return costs.
Returned items may need to be dropped off at a collection point.

Gifts
Promotional gifts are not eligible for voluntary return, replacement, or exchange, even if defective or received in random colour/model.

WARRANTY
New products carry a 3-year legal warranty (2 years if purchased before 01/01/2022).
Beeloom is responsible for transport, repair or replacement costs under warranty.
Users must report defects within 2 months of becoming aware.

Repairs or part replacements are subject to Technical Service evaluation. If damage results from misuse, wear, or other exclusions, costs will be charged to the user.

Warranty is void if:

  • Items show impact or misuse

  • Electrical surges cause damage

  • Items have been tampered with

  • Motor damage from lack of lubrication

  • Products show natural wear or require regular maintenance

Warranty excludes:

  • Third-party services/apps

  • Damage from weather or improper storage

  • Parts with a shorter natural life span (e.g. filters, spark plugs, chains)

  • Items bought through unauthorised resellers

  • Items sent outside the EU

Returns must be authorised and labelled with the assigned case number.

9. RIGHT OF WITHDRAWAL
In accordance with Spanish law, customers may withdraw from a contract within 14 days if the product is unopened.
Refunds will be processed upon inspection and returned via the original payment method within 14 days.
Return shipping costs are borne by the customer.

10. LIMITATION OF LIABILITY
Beeloom shall not be liable for:

  • Losses not attributable to its breach

  • Business losses or unforeseeable damages

  • Product display variations due to screen resolution or browser issues

  • Transport issues beyond its control

  • Force majeure events

11. WRITTEN COMMUNICATIONS
Users agree to electronic communications for contractual purposes. This includes all notifications and documentation.
Beeloom may communicate via email or postal address as provided by the user.

12. WAIVER
Failure by Beeloom to enforce any right shall not constitute a waiver unless expressly stated in writing.

13. SEVERABILITY
If any provision is declared invalid, the remaining terms shall remain in full force and effect.

14. ENTIRE AGREEMENT
These Terms and referenced documents constitute the entire agreement between Beeloom and the user, replacing prior verbal or written agreements.

15. DATA PROTECTION
Personal data will be processed in accordance with the Privacy Policy. Users declare that the information they provide is truthful.

16. COMPLAINTS AND CLAIMS
Users may submit complaints using the contact details provided above.
Official complaint forms are available upon request.
Users may also resolve disputes via the EU’s Online Dispute Resolution platform: http://ec.europa.eu/consumers/odr/

17. APPLICABLE LAW AND JURISDICTION
These Terms and all transactions via the Website are governed by Spanish law. Disputes shall be submitted to the non-exclusive jurisdiction of the Spanish courts.
